The government had not excluded it, and it is now done! A new period of confinement applies on French territory from October 30 to 1er December 2020. And, this time, the message from the public authorities is clear: all businesses that are not administratively closed must operate as normally as possible. In other words, employees must continue to work. It is up to employers, however, to take cognizance of and apply to the letter “the national protocol to ensure the health and safety of employees in the workplace in the face of the COVID-19 epidemic”.
Telework becomes the rule
Employees whose activities can be carried out remotely must telework 100% of their working time.
Only employees are authorized to come to the company for whom all or part of the activities cannot be carried out remotely.
Note: the employer sets the applicable rules within the framework of local social dialogue, ensuring that links are maintained within the work group and the prevention of risks linked to the isolation of employees working from home.
And when teleworking is not possible?
If teleworking cannot be set up, the employer must organize the work to make it possible to reduce home-work trips and adapt the time spent in the company. Concretely, he must put in place a smoothing of working hours in order to limit crowds at peak times.
And, of course, he must do everything to ensure that a physical distance of at least one meter between people (employee, customers, service providers, etc.), hand hygiene, barrier gestures, and so on. as cleaning, ventilation and aeration of the premises. As for wearing a mask, it remains compulsory in closed collective spaces (open space, meeting rooms, etc.).
Finally, audio or videoconference meetings should be the rule and face-to-face meetings the exception.
Important: the employer must inform employees of the existence of the “TousAntiCovid” application and of the benefits of activating it during working hours.
Proof of travel
Given the travel restrictions linked to confinement, employees who cannot telework 100% must have proof of professional travel. A certificate that allows the employee to go from his home to his place of work (or to the various places of work) and to make, at the request of his employer, business trips that cannot be postponed. The period of validity of the certificate is determined by the employer: it is therefore not necessary to renew it every day.

Note: self-employed workers, for whom this proof is not suitable, must provide themselves with the exceptional travel certificate by checking the first reason for travel.
